1. Definitions
- Service means the DP Capital Advisors website, loan application portal, DSA partner platform, and related support services.
- User means any individual or entity that accesses or uses the Service, including loan applicants and registered DSA partners.
- DSA Partner means a Direct Selling Agent registered with Us to refer, manage, or assist with loan enquiries through the Service.
- Loan Application means any request for credit or financial assistance submitted through the Service.
- Personal Data has the meaning given in Our Privacy Policy.
2. Nature of Our Services
DP Capital Advisors is a professional loan consultancy and DSA facilitation platform. We help customers explore loan options and connect with banks and NBFC partners across India.
Important: We are not a bank, NBFC, or direct lender. We do not guarantee loan approval, interest rates, disbursement timelines, or credit decisions. All lending decisions are made solely by the respective financial institution based on its policies and the applicant's eligibility.
Information on the Service is provided for general guidance only and does not constitute financial, legal, or tax advice. You should seek independent professional advice before making financial decisions.
3. Eligibility
By using the Service, You represent and warrant that:
- You are at least 18 years of age and legally competent to enter into binding contracts under Indian law;
- All information You provide is true, accurate, current, and complete;
- You will promptly update Your information if it changes;
- You are using the Service for lawful purposes only;
- Where You register as a DSA Partner, You hold valid authorization to operate as a loan agent or partner in accordance with applicable regulations.
4. User Accounts & DSA Registration
Certain features require account registration, including the DSA partner portal. When You create an account, You agree to:
- Provide accurate registration details and valid KYC documents where requested;
- Maintain the confidentiality of Your login credentials;
- Accept responsibility for all activity under Your account;
- Notify Us immediately of any unauthorized access or security breach.
We reserve the right to suspend, reject, or terminate any account that violates these Terms, provides false information, or engages in fraudulent or abusive conduct.
5. Loan Applications & Enquiries
When You submit a loan application or enquiry through the Service, You authorize Us and Our partner institutions to:
- Verify the information and documents You provide;
- Contact You by phone, SMS, email, or other channels regarding Your application;
- Share relevant application data with banks, NBFCs, credit bureaus, and service providers for processing and underwriting;
- Assign enquiries to registered DSA partners where applicable.
Submission of an application does not create a binding loan agreement. Any offer, sanction, or disbursement is subject to the lender's terms and Your acceptance of those terms.
6. DSA Partner Obligations
If You register as a DSA Partner, You additionally agree to:
- Comply with applicable RBI guidelines, lender policies, and anti-money laundering requirements;
- Not misrepresent loan products, interest rates, fees, or approval guarantees to customers;
- Handle customer data securely and only for legitimate business purposes;
- Not engage in unsolicited spam, misleading marketing, or collection of leads through unlawful means;
- Accept that commission structures, payouts, and eligibility are governed by separate partner agreements and platform policies displayed within the DSA portal.
We may withhold, adjust, or reverse commissions in cases of fraud, chargebacks, policy violations, or lender rejections attributable to misrepresentation.
7. Acceptable Use
You agree not to:
- Use the Service in any way that violates applicable laws or regulations;
- Submit false, misleading, or forged documents or identity information;
- Attempt to gain unauthorized access to systems, accounts, or data;
- Introduce viruses, malware, or harmful code;
- Scrape, copy, or reverse engineer any part of the Service without written consent;
- Harass, abuse, or harm other users, Our staff, or partner institutions;
- Use the Service for money laundering, terrorist financing, or other illegal activities.
8. Fees & Payments
Loan applicants are generally not charged by DP Capital Advisors for submitting enquiries through the public application forms, unless explicitly stated on a specific page or agreement.
DSA partners may be subject to commission-based compensation as outlined in the partner dashboard and applicable agreements. All applicable taxes, TDS, and statutory deductions shall be borne as per Indian law.
Any third-party fees charged by lenders, credit bureaus, or payment gateways are outside Our control and are governed by those parties' terms.
9. Intellectual Property
The Service, including its design, logos, text, graphics, software, and branding, is owned by or licensed to DP Capital Advisors and protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works from any part of the Service without Our prior written permission, except for personal, non-commercial use of publicly available pages.
10. Third-Party Links & Services
The Service may contain links to third-party websites, lenders, or tools. We do not control and are not responsible for the content, policies, or practices of third parties. Your use of third-party services is at Your own risk and subject to their terms.
11. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, We disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components, or that loan approvals or payouts will occur within any specific timeframe.
12. Limitation of Liability
To the maximum extent permitted by applicable law, DP Capital Advisors, its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunities, arising from:
- Your use of or inability to use the Service;
- Any loan rejection, delay, or terms imposed by a lender;
- Unauthorized access to or alteration of Your data;
- Conduct of third parties, including lenders and DSA partners.
Our total aggregate liability for any claim arising from these Terms or the Service shall not exceed the amount paid by You to Us (if any) in the twelve (12) months preceding the claim, or 2621455,000, whichever is lower, except where liability cannot be excluded under applicable law.
13. Indemnification
You agree to indemnify and hold harmless DP Capital Advisors and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from Your use of the Service, violation of these Terms, misrepresentation to lenders or customers, or infringement of any third-party rights.
14. Privacy
Your use of the Service is also governed by Our Privacy Policy, which explains how We collect, use, and protect Personal Data. By using the Service, You consent to such processing in accordance with the Privacy Policy.
15. Termination
We may suspend or terminate Your access to the Service immediately, without prior notice, if You breach these Terms or if We are required to do so by law or a partner institution.
Upon termination, provisions that by their nature should survive (including disclaimers, limitation of liability, indemnification, and governing law) shall remain in effect.
16. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Subject to applicable consumer protection laws, any dispute arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts at Kolkata, West Bengal, India.
